WRONGFUL DEATH

The phrase “wrongful death” refers to instances where a person is killed due to the negligence or misconduct of another person or company.   A wrongful death action is most often filed by the relatives of the individual who has died.  This includes immediate family members such as surviving spouses, children, and sometimes parents.

The facts which must be established to successfully pursue a wrongful death action are as follows: 1) The death of an individual; 2) caused by the negligence or intent to harm of another; 3) the survival of a family member who are suffering a monetary injury as a result of the death; and 4) the appointment of a personal representative.

A wrongful death claim can arise out of the following occurrences if they cause the death of an individual:

  • Medical malpractice;
  • Automobile accident;
  • Airplane accident;
  • Nursing home neglect;
  • Occupational exposure to hazardous conditions or substances;
  • Criminal behavior;
  • Death during a supervised activity; and
  • Police brutality.
