CHILD CUSTODY
In both Maryland and the District of Columbia, Court’s will focus on the best interest of the child when making a determination as to child custody. In other words, Court’s will seek to implement a child custody plan that it believes to be most beneficial to the child.
Court’s consider a number of factors when determining which parent will be the primary custodian of a minor child. These factors can include but are not limited to the following:
- The fitness of each parent;
- The character and reputation of each parent;
- The potential of maintaining natural family relations;
- The desires of the natural parents regarding custody;
- The preference of the child;
- Age, health and sex of the child;
- The suitability of each parent’s residence;
- How long the child has been separated from a natural parent seeking custody;
- The willingness of each parent to share custody;
- The quality of the relationship each parent has with the child;
- Any potential disruption of shared physical custody upon child’s social life and education;
- The distance between the parent’s homes;
- The demands of each parent’s job;
- Age and number of children involved; and
- The financial status of each parent.
