CHILD CUSTODY

In both Maryland and the District of Columbia, Court’s will focus on the best interest of the child when making a determination as to child custody.  In other words, Court’s will seek to implement a child custody plan that it believes to be most beneficial to the child.

Court’s consider a number of factors when determining which parent will be the primary custodian of a minor child.  These factors can include but are not limited to the following:

  • The fitness of each parent;
  • The character and reputation of each parent;
  • The potential of maintaining natural family relations;
  • The desires of the natural parents regarding custody;
  • The preference of the child;
  • Age, health and sex of the child;
  • The suitability of each parent’s residence;
  • How long the child has been separated from a natural parent seeking custody;
  • The willingness of each parent to share custody;
  • The quality of the relationship each parent has with the child;
  • Any potential disruption of shared physical custody upon child’s social life and education;
  • The distance between the parent’s homes;
  • The demands of each parent’s job;
  • Age and number of children involved; and
  • The financial status of each parent.
